I got a check from someone posing as an employer
for administrative work I performed over the
internet. I went to the bank with the check and
deposited it into my account. I informed the
teller that I had never dealt with this employer
and wanted to deposit the check and wait until it
had cleared to do anything with the money. She
told me to put a "hold" on the check for two
business days. She said that I could put a 5 day
hold on but she thought 2 would be sufficient.
After 5 business days, I went to the bank to
withdraw the money. She said the account still had
a hold on the check. I said well shouldn't it
have cleared? She said "let me check by going into
the system another way." She did something in the
computer and said yes, it should be clear. I said
so are you sure it's clear. She said yes, I just
released it. She then gave me most of the amount
of the check. I then spent the money immediately.
Later that day, the bank called me and asked me
to return the money as the check had come back
"insufficient funds." When I said that I didn't
have the money anymore, they said they would hold
me liable for negotiating a worthless instrument.
A few weeks later, a sheriff came to my door with
a "five day notice" stating I had to come up with
the money within five days. What are my rights
with regard to this money? the bank told me the
check was clear and the money was available to
take. |
